Sales Disclosure Documents

Homeowners are required, under Virginia state law, to provide a current sales disclosure packet (formally known as a Resale Certificate) to the next owner of their home prior to the sale. To obtain a Resale Certificate, send an email to hemingwayclusterHELP@gmail.com. You will receive a prompt response letting you know about the procedure and timing. Fees for HCA Board preparation of the Resale Certificate are shown below. Please allow up to 14 days for creation of the documents after your check is delivered.

  • Base fee is $175, which includes the following:
    • Property inspection to identify any covenant or maintenance violations
    • Re-inspection, if necessary, to confirm correction of any violations identified in the initial inspection
    • Preparation of resale certificate in required format, including 30 appendices, delivered electronically
  • Additional hard copy of resale certificate, if requested: $25
  • Delivery service fee, if requested hard copy is to be delivered to an address outside the Hemingway cluster: actual cost of delivery service
  • Updates to resale certificate, between 30 days and 12 months after initial resale certificate is prepared: $50
    • If the resale certificate is out of date by the time a contract for sale is signed, the seller or buyer is entitled to request an updated resale certificate
  • Updates to resale certificate, 12 or more months after initial resale certificate is prepared: $175
    • After 12 months, virtually all of the disclosures are out of date and the resale certificate preparation process must be started from scratch
